This agreement sets out the terms and conditions on which wireless internet access (“Wifi Service”) is provided to a guest / ("you") of Digantara Research and Technologies Private Limited ("Company" / "We").

Please read the following terms and conditions carefully before using the Wifi Service.

1. Extent of the Wifi Service
   1. We do not recommend in particular the use of any websites (or other internet related services) (“Internet Services”) and your use of the Internet Services is carried out entirely at your own risk.
   2. We have no responsibility for, or control over, the Internet Services you access and do not guarantee that the Wifi Service is error free or free from viruses or other harmful components.
   3. We have no responsibility for, or control over, the information you transmit or receive via the Wifi Service.
   4. Save for the purposes of network diagnostics we do not examine the use to which you put the Wifi Service or the nature of the information you send or receive.
   5. We do not guarantee:
      1. the availability of the Wifi Service; or
      2. the speed at which information may be transmitted or received via the Wifi Service; or
      3. that the Wifi Service will be compatible with your equipment or any software which you use.
   6. Whilst we take reasonable steps to ensure the security of the Wifi Services and to prevent unlawful access to information transmitted or received using the Wifi Service, we do not guarantee the security of the information which you may transmit or receive using the Wifi Service or located on any equipment utilizing the Wifi Service and you accept that it is your responsibility to protect your information and have adequate security (in terms of equipment and procedures) to ensure the security, integrity and confidentiality of your information and data.
   7. We reserve the right at all times to withdraw the Wifi Service, change the specifications or manner of use of the Wifi Service, to change access codes, usernames, passwords or other security information necessary to access the Wifi Service.
2. Acceptable Use of the Wifi Service
   1. You must NOT use the Wifi Service to access Internet Services, or send or receive emails, which:
      1. are defamatory, tortious, libelous, invasive of one's privacy, threatening, intimidatory or which could be classed as harassment;
      2. contain obscene, profane or abusive language or material;
      3. contain pornographic material (that is text, pictures, films, video clips of a sexually explicit or arousing nature);
      4. contain offensive or derogatory images regarding sex, race, religion, colour, origin, age, physical or mental disability, medical condition or sexual orientation;
      5. contain material which infringe third party’s rights (including intellectual property rights);
      6. intentionally or unintentionally violate applicable local, national or international laws or any regulations having the force of law;
      7. in our reasonable opinion may adversely affect the manner in which we carry out our business; or
      8. are otherwise unlawful or inappropriate.
   2. You must not use the Wifi Service to engage in any activity which constitutes or is capable of constituting a criminal offence in India or anywhere else.
   3. Music, video, pictures, text and other content on the internet are copyright works and you should not download, alter, email or otherwise use such content unless certain that the owner of such works has authorised its use by you.
   4. We may terminate or temporarily suspend the Wifi Service if we reasonably believe that you are in breach of any provisions of this agreement including but not limited to clauses 2(a) to 2(c) above.
   5. We recommend that you do not use the Wifi Service to transmit or receive any confidential information or data and should you choose to do so you do so at your own risk.
   6. The Wifi Service is intended for consumer use only. In the event that you use the Wifi Service for commercial purposes we would specifically refer you to clause 3(b) below.
   7. We do not screen or restrict communication between parties via the Wifi Service. You agree and acknowledge that if you access the Wifi Service and Internet Services, you may receive or be exposed to content, goods or services which may be improper, inaccurate, misleading, defamatory, obscene or offensive in nature. You agree that we are not liable for any action or inaction with respect to any such content accessible through the Wifi Services
3. Other Terms
   1. We may modify the terms and conditions of this agreement at our discretion, at any time. By using the Wifi Service after such modifications, you accept and agree to all such modifications.
   2. You shall defend, indemnify and hold the Company and their respective officers, directors and employees harmless from and against, and shall promptly reimburse them for, any and all losses, claims, damages, settlements, costs and liabilities of any nature whatsoever (including legal and attorney costs) to which they may become subject arising out of, based upon, as a result of, or in connection with, your use of the Wifi Service and/or Internet Servizces or any breach of this agreement.
   3. The Company, its directors, employees and officers are not liable for any costs or damages arising from your use of the Wifi Service or the Internet Services, including any direct, indirect, incidental, exemplary, special, punitive or consequential damages.
   4. You agree and acknowledge that we may be required to provide assistance and information to law enforcement, governmental agencies and other authorities.
   5. You agree and acknowledge that we may keep a log of the Internet Protocol (“IP”) addresses of any devices which access the Wifi Service, the times when they have accessed the Wifi Service and the activity associated with that IP address.
   6. You further agree we are entitled to co-operate with law enforcement authorities and rights-holders in the investigation of any suspected or alleged illegal activity by you which may include, but is not limited to, disclosure of such information as we have, and are entitled to provide by law, to law enforcement authorities or rights-holders.
   7. This agreement is governed by the laws of India and is subject to the exclusive jurisdiction of the courts at Bangalore, India.
